Italy: heated tobacco and herbal heated product regulation, May 2025

The Tobacco Products Directive (TPD)-implementing decree, legislative decree 6/2016, defines heated tobacco products as novel smokeless tobacco products, which are subject to more lenient regulation than cigarettes in terms of public place usage and taxation.

In September 2024, the government published a legislative decree establishing a new tax category for inhalation products without combustion, made from solid substances other than tobacco, with or without nicotine. Herbal heated products fall under this category.

This report offers detailed analysis of the regulatory framework in place in Italy for heated tobacco and herbal heated products, covering all policy areas form market access and taxation to advertising, labelling and public use.
