19th February 2025: Chile: The developing decree of law 21,642 has been published in the country’s official journal today. The decree and the law will both enter into force three months from now, on 19th May 2025. This means that from that date, heated tobacco products (HTPs) will be explicitly included in the tobacco framework in Chile, and will be subject to a comprehensive regulatory regime. The decree sets out the specific requirements for the labelling and health warning for e-cigarettes and tobacco products, including HTPs. Nicotine pouches have been left outside the scope of the reform, meaning that they remain subject to the pharmaceutical regime.
18th February 2025: Chile: The Ministry of Health has confirmed to TobaccoIntelligence that the developing decree of law 21,642 has been recently approved by the relevant authorities. The next step will be to publish it in the country’s official journal. The decree would put law 21,642 into effect, as the law was published in January 2024 to comprehensively regulate vaping products and to explicitly include heated tobacco products (HTPs) in the tobacco regime, but cannot enter into force until the developing decree is published.
21st March 2024: Chile: Yesterday, 20th March, the Ministry of Health presented the National Adult Action Plan against Cancer 2022-2027. The plan sets an objective to develop amendments to the tobacco control legislation in line with what is laid out in the World Health Organization Framework Convention on Tobacco Control (WHO FCTC) in relation to tobacco products and e-cigarettes.
11th January 2024: Chile: Member of parliament (MP) Andrés Celis from the opposition coalition has submitted a request to minister of health Ximena Aguilera to urge her to speed up the draft of the developing decree of the recently enacted law 21,642. The law explicitly includes heated tobacco products (HTPs) but does not enter into force until the developing decree is issued. The MP asks the minister to provide an estimated date of publication and an idea of the content of the decree.
8th January 2024: Chile: Law 21,642 amending the Tobacco Law to explicitly include heated tobacco products (HTPs) was published in the Official Gazette on 4th January 2024. The law will enter into force when the Ministry of Health issues the law's developing decree, which is expected by May 2024.
12th December 2023: Chile: The Constitutional Court declared bills 12626-11 and 12632-11 to be in conformity with the national Constitution last week. The bills, which seek to explicitly include heated tobacco products (HTPs) in the tobacco law, and to further regulate HTPs and their devices, will now be sent to the president for his signature.
5th October 2023: Chile: The Senate has approved bill 12626-11, which together with bill 12632-11 seeks to explicitly include heated tobacco products (HTPs) in the law on tobacco, and to further regulate them and their devices. The government is expected to pass it into law in the coming days.
2nd October 2023: Chile: The Senate Health Committee has approved bill 12626-11 which together with bill 12632-11 seeks to explicitly include heated tobacco products in the law on tobacco, and to further regulate them and devices. The Committee will recommend the Senate approves the bill without modifications. If approved by the Senate, the bill will lapse into law.
9th May 2023: Chile: The Chamber of Deputies yesterday approved Bill 12626-11, which together with Bill 12632-11 seeks to explicitly include heated tobacco products in the law on tobacco. The bill, introduced four years ago and approved by the Senate in March 2021, also includes certain provisions on devices and their components. However, it needs to be approved again by the Senate since the Chamber of Deputies proposed several modifications.
27th February 2023: Chile: The government is planning to introduce a bill in March 2023 setting out a new tax for tobacco products, press reports. Heated tobacco products are not currently subject to a specific tax, while snus and chewing tobacco are taxed at 59.5% of the retail price.
25th November 2022: Chile: The Health Committee of the Chamber of Deputies approved Bill 12626-11 on 22nd November. The bill, combined with Bill 12632-11, seeks to equate heated tobacco products with other traditional tobacco products. The bill also introduces certain provisions on devices and their components.
9th November 2022: Chile: The Chamber of Deputies Health Committee yesterday heard the government’s comments on Bill 12626-11, which, together with Bill 12632-11, seeks to equate heated tobacco products with other tobacco products. The committee has set a new deadline of 17th November to end discussion and decide on the bill, which also introduces certain provisions on devices and their components.
