20th February 2025: EU, Austria, Czech Republic, Greece, Italy, Poland, Romania, Slovakia: The comments and detailed opinions provided by the European Commission, the Czech Republic, Poland, Romania, Slovakia, Greece and Italy on the Austrian TRIS notification 2024/0610/AT have been published. The standstill period of the notification, which concerns an Austrian ordinance specifying prohibited substances in tobacco products and e-liquids, has been extended to 8th May based on the comments raised. All commenting countries argue that a ban on glycerol, proposed by the Austrian ordinance, would, in addition to going beyond EU requirements, result in a de facto ban on all e-liquids since glycerol is an essential ingredient in the manufacture of e-liquids and an important additive in tobacco products. This would effectively make the manufacture of vaping products technically unfeasible.

20th December 2024: Italy: Starting 1st January 2025, the excise duty on heated tobacco products (HTPs) and herbal heated products (HHPs) will increase from 38% to 39.5% of the duty on the equivalent quantity of cigarettes.
21st November 2024: EU: Italy and Romania have issued a joint statement raising concerns about the procedure of the discussions on the proposal for a revision of the 2009 Council recommendation on smoke-free environments. The two countries say they regret the failure by the European Commission to present a proper impact assessment for this act as a basis for the Council to properly assess the proposed recommendations, which is also a concern the Spanish Association of Personal Vaporiser Users (ANESVAP) raised last month. Italy and Romania also flag that many of the significant comments and amendments proposed by EU member states have not been adequately considered and included in the text.
28th October 2024: Italy: The Customs and Monopolies Agency (ADM) has updated the list of retail prices and excise duties for heated tobacco consumables and herbal heated products.
18th October 2024: Italy: The government has published a legislative decree establishing a new tax category for inhalation products without combustion, made from solid substances other than tobacco, with or without nicotine. Herbal heated products (HHPs) fall under this category. Heated tobacco product (HTP) excise duty applies, and the excise tax warehouse framework (including tax stamps) is extended to HHPs. The decree also applies e-cigarette product restrictions in terms of additives, advertising restrictions and packaging restrictions to HHPs. These products can only be sold through tobacconists, with both domestic and cross-border online sales banned. By the end of the year, the Customs and Monopolies Agency (ADM) will issue the relevant circulars to complement the framework introduced by the decree.
