12th November 2024: Netherlands: The bill amending the Tobacco and Smoking Products Act to completely ban oral nicotine products (such as nicotine pouches), which was approved by the Senate on 1st October, enters into force on the 1st January 2025. The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products (such as nicotine gels, stones, herbal heated products etc.) – in addition to e-cigarettes and herbal smoking products, which are already regulated. This means the advertising ban, the age limit and other sales restrictions for these products will apply to other tobacco-free nicotine products.
29th October 2024: Netherlands: The Dutch government has reacted positively to the European Commission (EC)’s plan to extend the existing smoke-free areas and concludes that many of these proposals are already being implemented.

The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products, other than e-cigarettes and herbal smoking products (such as nicotine gels, stones, herbal heated products etc.), which means that the advertising ban, the age limit and other sales restrictions for these products will apply. The date this enters into force date is to be determined by royal decree.
2nd October 2024: Netherlands: The bill amending the Tobacco and Smoking Products Act to completely ban oral nicotine products (such as nicotine pouches) was approved by the Senate plenary yesterday, 1st October. The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products, other than e-cigarettes and herbal smoking products (e.g. nicotine gels, stones, herbal heated products, etc.), which means that the advertising ban, the age limit and other sales restrictions for these products will apply. After being published in the Official Gazette, this act will enter into force at a time to be determined by royal decree.
25th September 2024: Netherlands: The bill to change the Tobacco and Smoking Products Act in order to completely ban nicotine pouches, which was voted in plenary on 21st May by the House of Representatives (lower chamber of parliament), has recently been discussed in the Senate plenary. The vote is scheduled to take place on 1st October.
12th September 2024: Netherlands: New Social Contract, a political party from the new Dutch coalition, is supporting the citizens’ initiative Nicotinee, which proposes a generational sales ban on nicotine products in the Netherlands, media reports. Launched at the end of 2022, the citizens’ initiative to achieve a nicotine-free generation – which aims to prohibit the sale of all nicotine-containing products to consumers born on or after 1st January 2012 and collected more than 40,000 signatures – was declared admissible in July 2024. The initiative will be put on the agenda of the House of Representatives for consideration, media reports.
10th September 2024: Netherlands: The government is considering implementing a registration requirement for tobacco and related products sellers to keep track of the number of sales points, media reports. The registration requirement is intended to come into force in January 2025. However, there are concerns about the limited capacity of the Food and Consumer Product Safety Authority (NVWA) to monitor compliance, as it’s likely not all sales outlets will register.

1st July 2024: Netherlands: A decree from the Ministry of Health, Welfare and Sport prohibits the sale of tobacco and related products in supermarkets and catering establishments from today. The Netherlands Food and Consumer Product Safety Authority has provided more details of the ban.

The new Dutch coalition is now being formed; however, its attitude to the tobacco and nicotine policies is still unclear.
13th June 2024: Netherlands: The new Dutch cabinet is to include 29 members, with 9 of them, including the minister of health, welfare and sport, chosen by the new coalition leader, the far-right Party for Freedom (PVV), media reports. Although this could influence the current tobacco policy in the Netherlands, it remains to be seen whether the new health minister would keep or reverse the current tobacco-related proposals. Reportedly, the new candidates for ministers will need to participate in interviews in the lower house of parliament, though no specific dates have been scheduled yet. 11th June 2024: Netherlands: Research conducted by the Dutch National Institute for Health and Environment (RIVM) on the 2023 tobacco product excise duty increase shows that this increase is influencing smokers’ behaviour. Following the tax increase, 28% of smokers attempted to quit, with 10% succeeding, while 18% of smokers decreased their tobacco consumption. On the other hand, there was an increase in the purchase of tobacco products from abroad following the excise duty hike. The RIVM recommends that policy-makers consider raising the excise duty on tobacco regularly, while also advocating for uniform tobacco policies across Europe.
