20th December 2024: Netherlands: The bill amending the Tobacco and Smoking Products Act to completely ban oral nicotine products (such as nicotine pouches), which was approved by the Senate on 1st October, enters into force on 1st January 2025. The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products (such as nicotine gels, stones, herbal heated products, etc.) – in addition to e-cigarettes and herbal smoking products, which are already regulated. This means the advertising ban, the age limit and other sales restrictions for these products will apply to other tobacco-free nicotine products.
20th December 2024: Netherlands: In a letter to the parliament, state secretary for youth, prevention and sport Vincent Karremans has informed the House of Representatives about Reports on Compliance with the Alcohol Act and the Tobacco and Smoking Products Act. The letter contains the results of the national compliance investigation on the age limit for alcohol and tobacco sales. This investigation is carried out every two years and provides insights into the extent to which young people can buy alcohol and tobacco via test purchases. The letter concludes that figures show young people can still easily obtain alcohol and tobacco as well as e-cigarettes. Supervising compliance with the age limit for the sale of tobacco and e-cigarettes, in the period from July 2023 to June 2024, the Netherlands Food and Consumer Product Safety Authority (NVWA) carried out 2,305 test purchase inspections. In 26% of the cases, a violation was found, and a measure was imposed.
19th December 2024: Netherlands: Last week, after the debate on the Nicotinee citizens’ initiative, the House of Representatives voted for a motion to have the government investigate a potential ban on the sale of nicotine products to individuals born on or after 1st January 2012, media reports. The House of Representatives also called for increased cooperation among enforcement authorities with regard to the Tobacco Act. The government is to provide clarity on this motion before summer. Additionally, nine other motions were adopted aimed at tougher regulations on the tobacco industry, improving smoking-cessation programmes for young people, expanding bans on smoking and vaping, and registering health issues related to vaping.
5th December 2024: Netherlands: The citizens’ initiative Nicotinee – launched at the end of 2022 and declared admissible in July 2024 – which aims to prohibit the sale of all nicotine-containing products to consumers born on or after 1st January 2012, will be debated in the House of Representatives next Thursday (12th December), media reports.

29th October 2024: Netherlands: The Dutch government has reacted positively to the European Commission (EC)’s plan to extend the existing smoke-free areas and concludes that many of these proposals are already being implemented.

The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products, other than e-cigarettes and herbal smoking products (such as nicotine gels, stones, herbal heated products etc.), which means that the advertising ban, the age limit and other sales restrictions for these products will apply. The date this enters into force date is to be determined by royal decree.
2nd October 2024: Netherlands: The bill amending the Tobacco and Smoking Products Act to completely ban oral nicotine products (such as nicotine pouches) was approved by the Senate plenary yesterday, 1st October. The bill also seeks to regulate nicotine products that do not contain tobacco but that can be used as an alternative to tobacco products, other than e-cigarettes and herbal smoking products (e.g. nicotine gels, stones, herbal heated products, etc.), which means that the advertising ban, the age limit and other sales restrictions for these products will apply. After being published in the Official Gazette, this act will enter into force at a time to be determined by royal decree.
25th September 2024: Netherlands: The bill to change the Tobacco and Smoking Products Act in order to completely ban nicotine pouches, which was voted in plenary on 21st May by the House of Representatives (lower chamber of parliament), has recently been discussed in the Senate plenary. The vote is scheduled to take place on 1st October.
12th September 2024: Netherlands: New Social Contract, a political party from the new Dutch coalition, is supporting the citizens’ initiative Nicotinee, which proposes a generational sales ban on nicotine products in the Netherlands, media reports. Launched at the end of 2022, the citizens’ initiative to achieve a nicotine-free generation – which aims to prohibit the sale of all nicotine-containing products to consumers born on or after 1st January 2012 and collected more than 40,000 signatures – was declared admissible in July 2024. The initiative will be put on the agenda of the House of Representatives for consideration, media reports.
10th September 2024: Netherlands: The government is considering implementing a registration requirement for tobacco and related products sellers to keep track of the number of sales points, media reports. The registration requirement is intended to come into force in January 2025. However, there are concerns about the limited capacity of the Food and Consumer Product Safety Authority (NVWA) to monitor compliance, as it’s likely not all sales outlets will register.
