The Law on the Protection of the Health of Citizens of Kyrgyzstan from the Consequences of Tobacco Consumption, Nicotine and Exposure to Second-hand Tobacco Smoke and Aerosol (the Tobacco Act) specifies that within the territory of Kyrgyzstan, the production, import and circulation (including storage, wholesale and retail trade, and export) of non-smoking tobacco products, with the exception of nasvay, is prohibited. The Tobacco Act defines non-smoking tobacco products as tobacco products intended for sucking, chewing, or sniffing, which means that these products are banned in Kyrgyzstan.

Nasvay is a traditional oral tobacco product consisting of a moist, powdered tobacco dip consumed mostly in Afghanistan and surrounding countries.

Heated tobacco consumables and devices for tobacco heating are regulated in Kyrgyzstan by the Law on the Protection of the Health of Citizens of Kyrgyzstan from the Consequences of Tobacco Consumption, Nicotine and Exposure to Second-hand Tobacco Smoke and Aerosol (the Tobacco Act).

The law mostly makes no distinction between heated tobacco and traditional cigarettes.
