Description
As in the other EU member states (except Sweden), the sale of oral tobacco products is explicitly banned in Spain, except for chewing tobacco. While currently, only consumer rules apply to nicotine pouches.
The government has been saying for years that it will be introducing new restrictions for tobacco and nicotine products. Most recently, the health minister confirmed that an amendment to the tobacco law is going to be introduced in the coming months, but no further details have been provided, meaning it is unclear if and to what extent the proposal will affect the sector.
Heated tobacco products are defined in Spain as novel tobacco products that are heated in order to produce an emission that contains nicotine and other chemical substances which are inhaled and that depending on their characteristics may be considered a non-combustible tobacco product or a smoking tobacco product.
In the next few years, the framework for heated tobacco will shift closer towards cigarettes. This is because the ruling parties, which recently secured their second term in office, hold a negative view of novel tobacco products.
