19th February 2024: US - New York: Bill A 9224 has been introduced, which would prohibit the sale of tobacco products and vapour products within 500 ft of a public or private school.
25th January 2024: US - General: New York Democrat Chuck Schumer is facing criticism from Republicans following his call for a crackdown on Zyn nicotine pouches. The Republicans criticised Schumer for prioritising the issue over the country's more important problems, media reports. Some Republicans said they weren’t familiar with the product or wanted to learn more. Republican senator Mike Braun said: “Where there's a health care consideration, everybody has to look at that. I don't like the government banning stuff either.” Historically, Democrats have often been associated with imposing strict tobacco laws compared with Republicans.
7th November 2023: US - New York: Bill A 8243 has been introduced. The bill would require random, quarterly inspections of retail premises authorised to sell tobacco and vapour products to ensure compliance with applicable laws and regulations.
18th September 2023: US - New York: Governor Kathy Hochul has signed public health legislation (A1025/S50) that amends the public buildings law to prohibit the sale of tobacco products in vending machines and at vending stands leasing space in buildings in the state. Future vendor leases and contracts will be subject to this prohibition. The governor said: “We’re cracking down on Big Tobacco by banning the sale of their harmful products in New York State buildings. Protecting public health is a top priority for me, and I will continue to discourage the sale and use of these dangerous, addictive products in New York.”
4th September 2023: US - New York: As of 1st September 2023, the cigarette tax has increased to $5.35 per pack from $4.35, making New York the state with the highest cigarette tax. The increase was approved as part of New York’s $229bn state budget. The tax would also apply to heated tobacco products.
19th April 2023: US - New York: Senate Bill S6395 has been introduced. The bill would prohibit the operation of any vending machine that dispenses tobacco products within 350 ft from a building that operates exclusively as a school or as a church, synagogue or other place of worship.
17th March 2023: US - New York: The New York State Senate and New York State Assembly have rejected governor Kathy Hochul’s proposal to ban sales of flavoured tobacco products, which would have included menthol cigarettes, media reports. The proposal was first introduced in February as part of the governor’s 2023-2024 fiscal year budget. Hochul’s proposal was opposed by the State Assembly and State Senate, but both groups did agree to raise cigarette taxes from $4.35 to $5.35, making New York the state with the highest tax for cigarettes. The tax would also apply to heated tobacco products. A final budget deal is expected by 1st April.
3rd March 2023: US - New York: State Assembly bill A 4932 has been introduced. This bill would prohibit the sale of any vapour or tobacco products containing the substance N-Ethyl-p-menthane-3-carboxamide, which creates a cooling sensation similar to menthol.
7th February 2023: US - New York: Governor Kathy Hochul has been criticised by state Democrats over the proposed statewide ban on tobacco and e-cigarette flavours, media reports. Critics say the proposed ban would be impractical to enforce and costly to state taxpayers. One said: “Small businesses in New York are at risk of being squeezed out by the proposed illegal tobacco regulations, which would only stimulate a larger underground market and encourage people to buy unregulated products.”
16th January 2023: US - New York: Many new bills have been introduced, including Bills A 699 and A 93. Bill A 699 would prohibit the sale of flavoured smokeless tobacco within 500 ft of a public or private school. The bill further provides for a definition of "flavoured smokeless tobacco" which would include any product made/derived of tobacco or nicotine intended to be placed in an oral cavity; the ban would comprise all flavours except tobacco. Bill A 93 would prohibit the distribution without charge or sale of flavoured nicotine pouches.
13th January 2023: US - New York: Bill A 86 has been introduced. This bill would increase the tax imposed on the sale of certain tobacco products from 75% to 129% and increase the tax imposed on the retail sale of vapour products from 20% to 48%.
