Guatemala: heated tobacco regulation, August 2023

The Health Ministry confirmed that there is no specific regulation for HTPs. However, if the product contains tobacco, relevant provisions from the Health Code, governmental agreements 299-2014 and 137-2009, and Decree 74-2008 apply.

Tobacco products are defined as “any article whose raw material is tobacco or tobacco derivatives, intended for consumption”.

This report provides details of the current regulatory framework in place for heated tobacco products in Guatemala, covering all policy areas from notification and taxation to advertising and labelling and packaging rules.
