Spain transposed the EU’s Tobacco Products Directive (TPD) into domestic legislation through Royal Decree 579/2017, adopted on 9th June 2017, and Royal Decree-Law 17/2017, adopted on 17th November 2017. Heated tobacco consumables are considered as a new category of tobacco products in Spain, while devices are not explicitly regulated and fall under general product safety laws. Oral tobacco pouches (snus) are banned in Spain, although tobacco-free ones are regulated by general consumer laws. This report covers all aspects of law from advertising and marketing to product restrictions, notification and taxation.
