Regulatory report: US – flavours in modern oral tobacco products

In the US, nicotine pouches falls into the definition of “tobacco product” under the Tobacco Control Act (TCA), but there are no specific federal restrictions, however, states may enact specific legislation regarding tobacco products without conflicting with federal law. Although many states have enacted flavour restrictions on e-cigarettes, no such restrictions currently apply to nicotine pouches. This could change, however, and a bill has already been proposed in New York that would specifically impose a flavour ban on nicotine pouches. This report examines this topic in futher detail.
