The Federal Tobacco Products Act, which entered into force on 1st October 2024, regulates both devices and consumables in line with traditional tobacco products.
A tobacco product is defined as “a product consisting of or containing leaf parts of plants of the genus Nicotiana ( tobacco) and intended for smoking, inhalation after heating or sniffing”. This wide category includes a tobacco product for heating, defined as any “device for inhaling emissions of a product containing tobacco heated by an external source of energy, as well as the refill material for this device”.
