Heated tobacco consumables are not specifically regulated in Spain but are considered novel smokeless tobacco products. The coalition government (formed by the Spanish Socialist Worker’s Party – PSOE – and far-left Podemos party) has been working for three years on several initiatives to comprehensively amend the tobacco control framework and specifically regulate all novel tobacco products. However, it is unlikely that it will have time to approve them before the end of the legislative term, which is due to end by 10th December 2023.

This report provides a detailed overview of the current regulatory framework in place for heated tobacco products, covering all policy areas from advertising and product restrictions to notification, taxation and packaging.
