8th May 2024: EU: The minutes of the 18th April meeting of the European Parliament's Committee on the Environment, Public Health and Food Safety have been published today. The Committee's members agreed to mandate the chair of the Committee to send a letter to the European Commission “to complain about the publication delays of several tobacco related documents”.
8th May 2024: Italy: The Customs and Monopolies Agency (ADM) has updated the list of nicotine pouches that are authorised for sale.
8th May 2024: Austria: At a conference held yesterday (7th May), state health officials spoke out in favour of a nationwide ban on tobacco-free nicotine pouches, press reports. The deputy governor of Upper Austria, Christine Haberlander, of the ruling Austrian People's Party, pointed out that Upper Austria already has a ban for under-18s, while adding “but this is not the case in all federal states”.
8th May 2024: Czech Republic: The State Agricultural and Food Inspection Authority has updated the list of notified tobacco products and their ingredients.
7th May 2024: Azerbaijan: The draft amendment to the Code of Administrative Offences included in today’s parliamentary meeting agenda seeks to establish a fine for activities in the manufacturing of tobacco products without registration, media reports. Failure to register these activities in the way specified by the law “On Tobacco and Tobacco Products” will incur a fine of between AZN5,000 ($2,940) and AZN12,000 ($7,060).
3rd May 2024: EU/France: France has requested to intervene in Case C‑731/23 P, Nicoventures Trading and Others vs Commission, in support of the European Commission (EC), and the Court of Justice of the European Union (CJEU) has granted permission. The case concerns the appeal brought by Nicoventures Trading on the decision of the General Court of the CJEU declaring admissible the applicants’ action for annulment of the Commission Delegated Directive (EU) 2022/210 0 that sets out the flavour ban for heated tobacco products (HTPs) across Europe.
3rd May 2024: Greece: The Ministry of Health has updated the list of notified tobacco products. The list contains herbal heated products, heated tobacco products and nicotine pouches, among others.
2nd May 2024: Poland: The government has announced that a bill taxing nicotine pouches and other innovative products will be introduced, press reports. The bill will propose an excise duty to be implemented in 2025 at a rate of PLN100 (€23) per kg. The excise duty would increase progressively to PLN200 (€46) per kg in 2026 and PLN300 (€69) per kg in 2027. It has been announced that the bill will also tackle other innovative tobacco-free products that are currently not taxed. TobaccoIntelligence believes that this new excise duty category would include herbal heated products. However, no further details have been revealed.
30th April 2024: Poland: The Parliamentary Team for Counteracting Addictions has started discussions on the regulation of nicotine pouches. Jarosław Neneman, secretary of state in the Ministry of Finance, has informed the press that the team has already held several meetings with industry members and has reached an agreement on how to regulate these products. Neneman also announced that an excise duty over nicotine pouches has been agreed and will be implemented. Bills in this regard are expected to be introduced in the coming months.
30th April 2024: Ukraine: The Cabinet of Ministers has adopted the resolution on approval of the procedure for maintaining the Unified State Register of equipment for the preparation or processing of tobacco, tobacco raw materials and industrial production of tobacco products, media reports.
29th April 2024: Russia: Bill 610727-8 has been introduced in the State Duma (lower chamber of parliament) that would amend the existing federal law provisions on advertising. The bill would prohibit the online distribution of data containing offers for the remote retail sale of tobacco and nicotine-containing products. It would further suggest establishing a mechanism for monitoring such information on social networks and a way to prevent access to the information. Online sales of these products are prohibited by federal law; however, lawmakers say information on remote sales is still easily found.
