Regulatory insights on herbal heated products in Europe, April 2024

Countries in Europe have started to draft and apply regulations for herbal heated products (HHPs), meaning the legal grey area under which they enter the market is now being addressed.

This report provides insights into the views of customs and health authorities in 28 European countries on herbal heated sticks. These products do not contain tobacco, may or may not contain nicotine, and are used with heating devices, as analysed in our market tracker.

In the absence of clear statutory rules, authorities were asked about their interpretation of the products, what regulations could indirectly apply, whether a product notification is required and if taxes apply.
